Projects eligible under the National Highway Performance Program, the Highway Safety Improvement Program, and for any purpose under chapter 1 of title 23, United States Code. Funding split among these eligibilities is outlined in law.
To be eligible for financial assistance, a project shall—(i) be designed to provide not less than 1,000 megawatts of storage capacity;(ii) be able to provide energy and capacity for use in more than 1 organized electricity market;(iii) be able to store electricity generated by intermittent renewable electricity projects located on Tribal land; and (iv) have received a preliminary permit from the Federal Energy Regulatory Commission.
To purchase power and transmission services, recover purchase power and wheeling services, and transfer to the Colorado River Basins Power Marketing Fund.

Eligible projects include: (1) a grade separation or closure, including through the use of a bridge, embankment, tunnel, or combination thereof; (2) track relocation; (3) the improvement or installation of protective devices, signals, signs, or other measures to improve safety, provided that such activities are related to a separation or relocation project described previously; (4) other means to improve the safety and mobility of people and goods at highway-rail grade crossings (including technological solutions); and (5) a group of related projects described previously that would collectively improve the mobility of people and goods. The planning, environmental review, and design of projects previously described are also eligible.an eligible project described in paragraphs (1) through (5).
(1) Grade separation or closure, including through the use of a bridge, embankment, tunnel, or combination thereof; (2) track relocation; (3) improvement or installation of protective devices, signals, signs, or other measures to improve safety related to a separation, closure, or track relocation project; (4) other means to improve the safety if related to the mobility of people and goods at highway-rail grade crossings (including technological solutions); (5) the planning, environmental review, and design of an eligible project type.
Railway-highway crossing projects
The facility established shall-- (A) provide environmental benefits through use of feedstock derived from acid mine drainage, mine waste, or other deleterious material; (B) separate mixed rare earth oxides into pure oxides of each rare earth element; (C) refine rare earth oxides into rare earth metals; and (D) provide for separation of rare earth oxides and refining into rare earth metals at a single site.
(A) Development and assessment of advanced separation technologies for the extraction and recovery of rare earth elements and other critical materials from coal and coal byproducts; and(B) Determine if there are, and mitigate, any potential environmental or public health impacts that could arise from the recovery of rare earth elements from coal-based resources.
